JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehend his arrest in a case registered for the offence punishable under sections 341, 323, 325, 307, 354/34, 504 of the Indian Penal Code.

It is alleged that all the accused persons including this petitioner indiscriminately assaulted the informant's side. It is further alleged that petitioner tried to set the house of the informant on fire but due to the intervention of the villagers, they could not succeed.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Specific allegation of assault is against other accused persons and no overt act has been alleged against him. Petitioner claims clean antecedent.

No.7334 of 2023(2) dt.18-04-2023 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, in connection with Supaul P.S. Case No. 815 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
