The accusation against the petitioner is that he set informant's hut on fire and from perusal of the impugned order, it would appear that some photographs of burnt hut have been annexed with the case diary.

It is submitted on behalf of the petitioner that no burnt articles were seized by the Investigating officer and mere annexing photograph with the case diary is not sufficient to prove the fact that hut of the informant was burnt.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in SC/ST Bhabua P.S.
