The petitioner is in custody in connection with Samho P.S. Case No. 32 of 2018 for the offence under Sections 447/ 342/ 323/379/ 307/328/120 B of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that petitioner has no criminal antecedent. He submits that allegation against this petitioner is that he has assaulted the nephew of informant and poured something in his mouth. Learned counsel for the petitioner next contended that the alleged occurrence took place on 22.07.2018 whereas case was lodged on 25.07.2018 without any explanation.
