JUSTICE SHIVAJI PANDEY ORAL ORDER 08-02-2019 Learned counsel for the petitioners submits that since the petitioner no.1, namely, Sudesh Singh has already been arrested during the pendency of this application, his bail application has rendered infructuous.
Accordingly, bail application of the petitioner no.1 is dismissed having become infructuous.
Heard learned counsel for the petitioner no.2 and learned counsel for the State.
In this case, the petitioner no.2 is seeking anticipatory bail in connection with Deo P.S. Case No.136 of 2018, registered for the offence punishable under Sections 341, 323, 324, 325, 307, 34 of the Indian Penal Code. Allegation has been made that there are some
Patna High Court Cr.Misc. No.7082 of 2019(2) dt.08-02-2019 2/2 dispute with respect to sowing of the Masuri crop and altercation took place between the informant and accused persons including the petitioner. Thereafter, at the instigation of Shanti Kuwar, the present petitioner, Sudesh Singh assaulted the informant with Tangi.
Learned counsel for the petitioner no.2 submits that, as per allegation, she is only order giver and 72 years old. Looking to the entire facts and circumstances of the case, let the petitioner no.2, above-named, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case no.136 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
