JUSTICE SUDHIR SINGH ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is to have killed son of the informant along with other accused persons. It has been submitted on behalf of the petitioner that he is in custody since 24.2.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been named merely on the basis of suspicion along with some unknown accused persons. No specific allegation has been made against the petitioner. There is no eye witness to the alleged occurrence. It is a case and counter case and counter case is placed at Annexure-2 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Paswan, 4th Addl. Sessions Judge, Naugachia, Bhagalpur, in connection with Sessions Trial no. 326 of 2015 arising out of Bihpur P.S. Case no. 195 of 2014.
