The petitioner seeks regular bail in connection with Raffiganj PS case no. 228 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The allegation is regarding recovery of 210 liters of illicit liquor from a tempo and the petitioner and other accused persons were caught by the police.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and it has been averred in para 7 of the present petition that the petitioner was merely a passenger in the said tempo while the driver and other co-passengers managed to flee away. Patna High Court Cr.Misc. No.7376 of 2019(2) dt.08-02-2019 2/2 further submitted that the petitioner is having a clean antecedent and is languishing in custody since 19.12.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge, (Excise), Aurangabad in connection with Rafiganj PS case no. 228 of 2018.
