JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 369, 354, 354 (A), (i ) (ii), 34 of the Indian Penal Code.
In the FIR, it is alleged that this petitioner along with other co-accused persons were outraging the modesty of the informant and when she raised alarm nearby persons assembled and one of the co-accused was caught whereas others were fled away.
Learned counsel for the petitioner submits that the petitioner has been falsely been implicated in this case due to old dispute. It is submitted that informant was well known to one of the co-accused Wasim and other associates of Wasim including petitioner and upon call of Informant Wasim and all his associated came to settle previous dispute amicably.

Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Gaya, in Civil Line P.S. case no.258 of 2014 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
