1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Ghoshi Police Station Case No. 264 of 2024 dated 27.05.2024, disclosing offences under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
3. As per the prosecution case, on 25.05.2024 in the afternoon, informant's brother was moving around his field and in the meanwhile, petitioner No. 1 started abusing him and the matter was resolved after negotiation. Subsequently, petitioner No. 1 arrived at about 09:00 P.M. at the house of the informant
Patna High Court CR. MISC. No.5926 of 2025(4) dt.23-07-2025 2/3 and try to drive away the tractor of the informant which was parked in the door of his house. When the informant protested, petitioner No. 1 assaulted him by means of sharp cutting weapon, due of which he sustained injury on his head. When the informant's brother intervened, petitioner No. 2 assaulted him by rod.
4. Learned Counsel for the petitioners submits that both the parties are agnates and there was previous dispute between them. The injuries sustained by the victims are simple in nature. There is no injury report of the informant's brother.
5. Learned Counsel for the State submits that the injury report of the informant is on record and it appears that injures caused to him is simple in nature.
6. Having regard to the submissions made on behalf of the parties, taking into consideration the fact that both the parties are agnates and the injuries sustained by the victims are simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.5926 of 2025(4) dt.23-07-2025 3/3 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Ghoshi Police Station Case No. 264 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
