1. The present petition has been filed for modification of the order dated 19.08.2023, passed in Cr.Misc No.52078 of 2023 to the extent of extending the time granted to the petitioner for surrendering before the learned Court of A.C.J.M.-XIV, Patna in connection with Gandhi Maidan P.S. Case No.80 of 2017, in order to avail the privilege of bail.

2. The learned counsel for the petitioners has submitted that on account of the order of this Court having not been communicated to the petitioner in time, the time granted to him to surrender before the learned trial Court had stood expired, hence a sympathetic view be taken and the time granted to the petitioner to surrender before the learned trial Court and

3. Per contra, the learned APP for the State has submitted that it is for this Court to grant indulgence or negate the prayer made by the petitioner.

4. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time granted to the petitioner to surrender before the learned trial Court vide order dated 19.08.2023 by a further period of four weeks from today.

5. The present petition stands disposed off with the aforesaid modification in the order dated 19.08.2023 passed in Cr.Misc. No.52078 of 2023.
