Petitioner is not named in the first information report and it appears from perusal of the impugned order that in course of investigation, it came to light that co-accused Sitaram Sah and Harinandan Yadav Panchayat Sewak identified the informant and on the basis of their identification, pumping set was given. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Mahishi P.S. Case no. 43/2005.
