At the outset, learned counsel for the petitioners has submitted that during the pendency of this anticipatory bail application, petitioner nos. 2 and 3 have been arrested and, as such, the same has become infructuous. He, therefore, seeks permission to withdraw this application as against petitioner nos 2 and 3.

In view of the aforesaid submission, the application is

Heard the learned counsel appearing on behalf of the petitioners and Mr. Shailendra Kumar, the learned APP for the State.

Petitioner no. 1 apprehends her arrest for the offences alleged under Sections 498, 504, 506 and 354(A) of the Indian Penal Code and subsequently Sections 366, 494, 379, 323 and 34 of the IPC were added, registered in connection with Begusarai Mahila P.S.Case No. 31 of 2021.

As per allegation, co-accused Saurav Kumar on the pretext of marriage, developed physical relation with the informant, but later on he refused to marry her. Learned counsel for the petitioners has submitted that petitioner no.1 Meena Devi is the aunt of the main accused Sarurav Kumar. There is no allegation at all against her in the entire FIR. She is a lady of clean antecedent. Considering the above facts and circumstances, let petitioner no. 1 above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.7605 of 2022(2) dt.22-07-2022 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusari Mahila P.S.case No. 31 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all the defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
