The petitioner seeks bail in a case under Section 395 of the Indian Penal Code.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Even during the course of investigation the only evidence that has come against the petitioner and other accused persons that they were found roaming around the place of occurrence. The petitioner is in jail since 19.09.2014 but he has not been put on T. I. Parade and similarly situated other accused persons have already enlarged on bail.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.41566 of 2015 (2) dt.10-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, learned Judicial Magistrate, 1st class, Patna City, Patna in Didarganj P.S. Case No. 163 of 2014 (G.R. No. 2803 of 2014).
