Petitioner is named in the first information report but submission on behalf of the petitioner is that having more or less similar allegation several co-accused persons have already been granted privilege of bail by a coordinate bench of this court and so far as petitioner is concerned, he has been dragged in his case on account of enmity.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge V, Aurangabad in Sessions trial no. 269 of 2014/ 80 of 2014 arising out of Khudwan P.S. Case no. 47/2013 subject to the condition that he shall appear before Superintendent of Police, Aurangabad within 15

No.4150 of 2015 (2) dt.30-01-2015 days from judicial custody and shall produce a copy of this order before him and he shall make his presence before the officer-in charge, Khudwan police station in the first week of each month for the period of nine months and if he fails to do so, officer-in charge, Khudwan police station shall send a report to the concerned court about the conduct of the petitioner and thereafter having got the report from the officer-in charge, Khudwan police station, the concerned court shall initiate a proceeding of cancellation of bail of the petitioner and shall pass appropriate order in accordance with law. shahid (Hemant Kumar Srivastava,J) U T
