The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, four accused persons are stated to have fired on the informant and of having stolen Rs. 1.49 lacs in cash and two mobile phones from the assistant of the informant.
It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in the confessional statement of coaccused Ajay Sahni who has himself been enlarged on bail vide
Patna High Court CR. MISC. No.17494 of 2021(8) dt.15-12-2021 2/2 order dated 17.10.2021 passed in Cr. Misc. no. 45760 of 2017. Inspite of being in custody since 18.11.2019 petitioner has not been put on T.I Parade. No incriminating article has been recovered from the petitioner's possession.
The application for bail is opposed by learned APP for the State who submits that the petitioner has large number of antecedents.
Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to coaccused Ajay Sahni on whose confessional statement the name of the petitioner transpired and the petitioner having remained in custody for over two years, the Court directs the petitioner to be enlarged on bail in connection with Cheria Bariyarpur P.S. Case no. 93 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Manjhaul, District Begusarai.
