JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Both the above stated petitions arise out of Kishanpur P.S.Case No. 56 of 2015 registered under sections 304B,201,120B of the Indian Penal Code Accordingly, both the above stated petitions have been heard together and are being disposed of by this common order.

Petitioners in Cr. Misc. No. 37932 of 2015 are in-laws whereas petitioner in Cr. Misc. No. 44649 of 2015 is husband of the deceased, whose dead body wrapped with mat was recovered

Patna High Court Cr.Misc. No.37932 of 2015 (3) dt.05-11-2015 2/2 near a river after institution of the present case. There is accusation of illegal demand and the deceased died within seven years of her marriage, Learned counsel for the petitioners submits that petitioners in Cr. Misc. No. 37932 of 2015 were residing separately from petitioner in Cr. Misc. No. 44649 of 2015 and as a matter of fact, deceased went missing and after that information was given to the informant and having received the information, the informant came and lodged the present case. Considering the aforesaid facts and circumstances as well as submissions of the parties, Petitioners in Cr Misc. No. 37932 of 2015 namely, Upendra Yadav and Shiv Shankar Yadav are directed to be released on bail on furnishing bail bonds of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Supaul in connection with Kishanpur P.S.Case No. 56 of 2015. So far as prayer for bail of the petitioner in Cr. Misc. No.44649 of 2015 is concerned, the same stands rejected, at least at this stage.
