Mr.Upendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. C628 of 2016, corresponding to Trial No. 1297 of 2017, in which cognizance has been taken under Section 420 IPC.
Allegation against the petitioner is of taking Rs.80,000/- for providing job to the son of the complainant in Foreign and thereafter he was provided documents and on that basis he had gone to the foreign country and when he showed his papers the officers of the company told him that the papers were forged.
Submission of learned counsel for the petitioner is that there is absolutely nothing against the petitioner to show
Patna High Court CR. MISC. No.8460 of 2019(3) dt.23-04-2019 2/2 that he has taken Rs.80,000/- and all the allegations are false and concocted.
Heard learned APP and learned counsel for the complainant, who has opposed the prayer for anticipatory bail. Having heard both sides and in the facts and circumstances and also considering the fact that petitioner has sent son of the complainant to foreign country with forged papers, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He should surrender and make prayer for regular bail, which shall be considered on the basis of materials available on the record.
With the above observation, this application is dismissed.
