JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 29.06.2014 in a case registered for the offences punishable under Section 394 of the I.P.C.
It is alleged that informant's Pass Book, driving license, mobile with two SIM and cash of Rs. 26,000/- were robbed by the miscreants. The F.I.R. has been registered against unknown. The name of the petitioner sprang up during investigation and from the possession of the petitioner two mobiles were recovered. Though the petitioner is disputing that recovered mobiles is not actually robbed mobile. It is orally submitted by learned counsel for the petitioner that petitioner has never been put on T.I.P. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.40331 of 2014 (3) dt.16-01-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 148 of 2014.
