JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 15-12-2017 Having heard learned counsel for the parties, we find that the house and land of the petitioners situated at Village- Murgia Chak, Anchal- Jamui, P.S. Jamui, District- Jamui has been sealed in connection with Confiscation Case No.6 of 2016 for violation of Bihar Prohibition and Excise (Amendment) Act, 2016.
It is common ground that in various cases, identical in nature, pending finalization of the confiscation proceedings
Patna High Court CWJC No.17379 of 2017(2) dt.15-12-2017 2/2 vehicles have been directed to be released by this Court on various conditions and we see no reason to make a deviation in the present case.
In view of the above, we direct the District Magistratecum-Collector, Jamui to ensure that the house in question mentioned hereinabove, is unsealed and possession handed over to the petitioners forthwith, in connection with the aforementioned case, on their furnishing two sureties to the satisfaction of District Magistrate-cum-Collector, Jamui subject to the condition that the petitioners shall not alienate or create third party interest with the land and house in question in any manner so as to prejudice the right of the State in confiscation proceeding.
With the aforesaid, the writ petition is allowed and disposed of.
