====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-06-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 325, 354, 447, 379, 504, 506 of the Indian Penal Code.

The prosecution case as per F.I.R is that Bhurkunda PACS purchased 1612 quintals of paddy from the farmers and as per proportionate system, the said PACS had to deposit CMR of 1080 quintals worth Rs. 28,21,000/- but the petitioner being Chairman of the PACS sold the aforesaid paddy in connivance with the

A supplementary affidavit has been filed on behalf of the petitioner to the effect that petitioner is ready to deposit Rs. 23,00,000/- in the District Cooperative Bank, Aurangabad, provided he may be given time for six months and the aforesaid amount may be permitted to be deposited in equal installments in six months.

The petitioner is directed to deposit 50 percent of Rs. 23,00,000/- i.e. Rs. 11,50,000/- before filing bail bonds before District Cooperative Office, Aurangabad and show receipt of the aforesaid deposit at the time of filing of the bail bonds. With regard to rest amount of Rs. 11,50,000/-, the petitioner is directed to deposit rest of the amount within a period of two months from today. The aforesaid deposited amount will be subject to the final outcome of the case.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or

No.17710 of 2021(9) dt.29-06-2022 3/3 surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 09 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The bail bonds of the petitioner will be accepted on showing receipt of deposit of Rs. 11,50,000/- to the District Cooperative Bank, Aurangabad.
