The petitioner is languishing in judicial custody since 20.12.2018 in connection with Minapur P.S. Case No. 548 of 2018 for the offences alleged under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a), 38, 41 and 48 of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel is that on secret information, that the petitioner is engaged in manufacturing and selling of country made liquor, raided the house of the petitioner and 2 liters of country made liquor was recovered, a plastic jar containing 10 liters unmanufactured country made liquor, one bottle and one tin having plastic pipe with cap were also found. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and
Patna High Court Cr.Misc. No.7736 of 2019(2) dt.11-02-2019 2/2 has been falsely implicated in the aforesaid case. Petitioner, further, undertakes not to induce the prosecution witnesses or temper with the evidence.
However, the learned Additional Public Prosecutor for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Minapur P.S. Case No. 548 of 2018 to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
