The petitioner is in custody in connection with Chowk P.S. Case No. 376 of 2018 for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that the name of the petitioner surfaced on the confessional statement of co-accused Kanhai Das. Learned counsel for the petitioner next contended that co-accused Arun Rai has been granted bail by the Court below.

Considering the fact that petitioner has no criminal antecedent and the name of the petitioner surfaced on the

No.8118 of 2019(2) dt.13-02-2019 2/2 confessional statement of the co-accused and similarly circumstanced other co-accused has been granted bail, let, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M.-II, Patna City, District- Patna in connection with Chowk P.S. Case No. 376 of 2018.
