The petitioner has preferred this application for grant of regular bail in a case registered under sections 401 and 414 of the Indian Penal Code.
As per allegations in the FIR, one accused person was caught with the stolen motorcycle and it is stated that on his confessional statement a stolen motorcycle was recovered from the possession of this petitioner.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his person or possession. He has been falsely implicated in the case. The alleged place of recovery is a road side. The petitioner is in custody since 3.10.2020 and investigation in the case has

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for 11 months, the Court directs the petitioner to be enlarged on bail in connection with Bagha 515 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bagha, West Champaran.
