JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Kesariya P.S. Case No. 323 of 2019 for offences under Sections 420, 467, 468 and 120B of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. The allegation against the petitioners is that they with conspiracy to each other got the sale deed executed in favour of one Gayatri Devi by the sister of petitioner no. 1 who is lady of dull mind.
Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.7337 of 2020(2) dt.29-02-2020 2/2 neither the petitioners are beneficiaries of the sale deed nor they are involved in transfer of land.
Considering the fact that the petitioners have no criminal antecedents, this Court is inclined to grant bail to them. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, District Champaran in connection with Kesariya P.S. Case No. 323 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) BT/- U
