The petitioner seeks bail in a case under Section 326(A) and other sections of the Indian Penal Code. The informant was sleeping with her son but some liquid was thrown and her son cried out. The informant saw Vikash Kumar, the petitioner, fleeing away.
It is submitted that there was dark night and it was not possible to identify the person standing outside the house without any source of light. It is submitted that the injuries found on the person of informant and her son are simple in nature. The petitioner is in jail since 28.06.2015, i.e., for about three months. Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.43634 of 2015 (2) dt.21-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, West Champaran at Bettiah in Lauriya P.S. Case No. 132 of 2015.
