The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 413, 414 of the Indian Penal Code.

As per FIR, prosecution case relates to recovery of stolen Bolero vehicle and the petitioner is alleged to be fled away from the place of occurrence who was involved in the selling the stolen vehicle.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Neither the petitioner was arrested on spot nor stolen vehicle was recovered from possession of this petitioner rather his name has been disclosed in this case by the co-accused namely, Vakil Kumar

Patna High Court CR. MISC. No.15710 of 2023(2) dt.28-04-2023 2/2 who was apprehended on spot. The petitioner has no concern with the alleged recovery of vehicle in question or with coaccused and he has falsely been made accused in the present case. It is further submitted that the petitioner is languishing in judicial custody since 30.8.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Industrial Area P.S. Case No. 46 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
