1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners after arguing vehemently for some time realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1 and 3.
3. Permission is accorded.
4. The petitioner no.2 apprehend his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 3(5) of the B.N.S.S.
5. Learned counsel for the petitioner submits that petitioner no.2 is a person with clean antecedent and from perusal of the allegation as alleged in the FIR, it would manifest
Patna High Court CR. MISC. No.7489 of 2025(4) dt.02-07-2025 2/2 that Md. Bashir is alleged to have assaulted the brother of the informant by knife causing injury on head and thereafter Md. Shabbir and Masum along with his wife are alleged to have assaulted the informant and Masum is alleged to have assaulted by khanti, causing grievous injury to the informant on his head. It is next submitted that no specific allegation is alleged against the petitioner no.2 rather allegation against him is general and omnibus in nature.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Hayaghat P.S. Case No.148/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
