The petitioner seeks bail in a case under Section 395 of the Indian Penal Code.

The informant identified the petitioner, Deva Yadav, and Om Prakash Yadav while they were committing dacoity in the shop of the informant.

It is submitted that for the same occurrence the police lodged Phulparas P.S. case No. 7 of 2015 in which name of the petitioner figured in the confessional statement of co-accused Ranjeet Mishra, who was apprehended while fleeing away from the place of occurrence. The petitioner is also named in Phulparas P.S. case No. 6 of 2015.

It is submitted that similarly situated accused Sunil

Patna High Court Cr.Misc. No.42282 of 2015 (2) dt.16-09-2015 2/2 Yadav has already been enlarged on bail.

From the perusal of the records, it appears that the informant identified the petitioner and Om Prakash Yadav and thereafter Ranjeet Mishra, who was apprehended while fleeing away from the occurrence, also disclosed the name of the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
