JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-08-2018 The petitioner claims that he passed Matriculation Examination held by the Bihar School Examination Board, in 1983. In support of his claim, he has brought on record the marks statement issued by the Bihar School Examination Board by way of Annexure-1. It is her grievance that she has yet not received her Matriculation Certificate.

It is the petitioner's case that based on her Matriculation result, she has pursued higher studies and still pursuing studies for which she needs the Matriculation Certificate.

Patna High Court CWJC No.6199 of 2018(2) dt.06-08-2018 2/2 Learned counsel appearing on behalf of the Board, on the other hand, has submitted that this application filed nearly 35 years after the petitioner passed the Matriculation Examination, should not be entertained and should be dismissed on the ground of delay and latches.

Be that as it may, since the petitioner is in need of Matriculation Certificate, she shall be at liberty to apply for duplicate copy of the said certificate from the Board. If such application for issuance of duplicate Matriculation Certificate is made within one month from today, the Board shall ensure that duplicate Matriculation Certificate is made available to the petitioner, if she is found eligible, within a period of two months, thereafter.

The petitioner shall be at liberty to request the Board for return of the original documents which she claims to have submitted before the Board for the purpose of issuance of original Matriculation Certificate.

This disposes of the application.
