Petitioner seeks bail in a case registered for the offences punishable under Sections 364 and 120B of the Indian Penal Code.

According to FIR, son of the informant, namely, Manoj Yadav left his house along with his relative Ram Surat Yadav at about 04:00 p.m. on 24.07.2018. On a mobile call by a relative Ranjan Yadav, both informed that they were in Sonebarsa and they will be returned back within one and half hour. Thereafter, mobiles of the victims were switched off and subsequently they were found traceless. Suspicion is there against the petitioner and others to have abducted both the

Learned counsel for the petitioner submits that there is no witness to support that the petitioner was ever seen along with the two kidnapped person. Merely suspicion is there and on suspicion, the petitioner was apprehended by the police and his confession has been recorded by the police while in police custody. Petitioner is in custody since 14.11.2018. Investigation of the case is already complete against the petitioner. Learned counsel for the informant opposed the prayer for bail on the basis of confessional statement of the petitioner before the police.

Considering the fact that there is no substantial material against the petitioner for the purpose of consideration of this prayer for bail as well as the fact that co-accused Manjeet Singh, has already been allowed bail by a Coordinate Bench of this Court vide order dated 02.11.2018 passed in Cr. Misc. No. 59137 of 2018 (Annexure-6), let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jagdishpur Police Station Case No. 285 of 2018, subject to the condition that the petitioner shall
