JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-05-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Muzaffarpur Town P.S. Case No. 696 of 2018, registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

FIR has been registered against unknown persons and the name of the present petitioner was figured in the confessional statement of co-accused Sushil Kumar Chhaparia and Shyamnandan Mishra who have been granted regular bail by the coordinate Bench of this Court.

No.6020 of 2020(4) dt.11-05-2022 2/2 Learned counsel for the petitioner has submitted that on similar ground co-accused Ashutosh Kumar @ Ashutosh Kumar Shahi was granted anticipatory bail by the coordinate Bench vide order dated 29.11.2019 in Cr. Misc No. 71355 of 2019. Similarly coaccused Pradyuman Kumar Sharma @ Mantu Sharma was also granted anticipatory bail by the coordinate bench vide order dated 04.02.2020 in Cr. Misc No. 70341 of 2019 and the case of the present petitioner is on similar footing.

Considering the above-mentioned facts and circumstances as well as the fact that on similar footing co-accused persons have been granted anticipatory bail by the coordinate Bench, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur in connection with Town P.S. Case No. 696 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
