JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-03-2022 Heard Mr. Uday Prakash Sharma, learned Advocate for the petitioners and Mr. Ram Priya Sharan Singh for the State. The petitioners seek bail in anticipation of their arrest in connection with Kudhani P.S. Case No. 698 of 2020 dated 18.11.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 354, 504 of the Indian Penal Code. They are alleged to have assaulted the members of the prosecution party.

No.17551 of 2021(2) dt.09-03-2022 2/2 The learned counsel for the petitioners has submitted that there is a complaint case lodged by one of the accused persons against the present prosecution party because of their attempt at dispossessing the petitioners from a plot of land over which there are competing claims.

The petitioners are agnates of the informant and the injuries suffered by the victims are all stated to be simple in nature.

Regard being had to the nature of accusation against the petitioners and taking into account their clean antecedent, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st West, Muzaffarpur in connection with Kudhani P.S. Case No. 698 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
