Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Patepur P.S. Case No. 203 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The petitioner had earlier approached this Court for grant of regular bail which was rejected by an order dated 14.10.2020 passed in Cr. Misc. No. 25836 of 2020. He is in custody since 16.02.2020 on the allegation that 623.160 liters of

Patna High Court CR. MISC. No.18162 of 2021(2) dt.28-07-2021 2/2 Indian made foreign liquor was recovered from his possession. Considering the period of incarceration and there being no likelihood of trial being concluded expeditiously, in near future, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise Court, Vaishali in Patepur P.S.
