Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148, 149, 323, 307, 325, 427, 504 of the Indian Penal Code.
On the alleged date and time of occurrence, all the FIR named accused persons including these petitioners armed with deadly weapons assaulted the informant, his son and daughter-in-law.
Learned counsel for the petitioners submits that on account of land dispute between the parties a simple occurrence of maarpeet took place between them. Allegation of assault is

FIR has been lodged after delay of two months, which itself creates doubt over the veracity of the prosecution case. Petitioners claim clean antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Ld. C.J.M. Bhagalpur in connection with Shahkund P.S. Case No. 184 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
