ANJANA MISHRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 29.7.2014 in Sahebganj P.S.Case No.207/14 for the offence under Sections 302/307/34 of the I.P.C.
The allegation against the petitioner is that she along with her husband participated in pouring kerosene oil on her sister-in-law and also took active role in igniting the same resulting in fire in which her Gotani and her small children caught fire.
Case diary of this case has been called for. On perusal of the case diary it appears that the petitioner had an active role to play in the occurrence which led to the death of the boy as
Patna High Court Cr.Misc. No.40076 of 2014 (3) dt.14-01-2015 2/2 well as the victim lady.
It has been submitted by the learned counsel for the informant that the daughter of the victim Indu Devi, namely, Khushboo Devi has made her statement under Section 164 Cr.P.C stating specifically that it was "Bari Mammi" who had, in fact, lit the match which caused the fire.
Considering the overwhelming materials in the case diary, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.
