In this case, the petitioner is seeking regular bail in connection with Gangabridge P.S. Case No. 215 of 2021, registered for the offences punishable under Sections 395, 412 of Indian Penal Code.

As per allegation, some miscreants came to the petrol pump and at the point of pistol they looted Rs. 47,594/- from the nozzle man who was on duty.

The learned counsel for the petitioner has submitted that the name of the petitioner has figured in confessional statement of Pankaj Kumar and Ladla @ Tajuddin and later on the confessional statement of the petitioner was also recorded. He has also submitted that he has falsely been implicated and Rs. 1200/- recovered from

Patna High Court CR. MISC. No.12418 of 2023(2) dt.12-05-2023 2/2 his house which is his own money and on similar footing Pankaj Kumar and Ladla @ Tajuddin have been granted bail in Cr. Misc. No. 50229 of 2022 and Cr. Misc. No. 44438 of 2022 respectively. Considering the above-mentioned facts and circumstances clean antecedents as well as the period of detention, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, Vaishali at Hajipur, in connection with Gangabridge P.S. Case No. 215 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
