====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-10-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 342, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, all the FIR named accused persons including this petitioner overpowered the informant and when he tried to escape, petitioner caught hold of him and with the help of other accused persons tied him with the electric pole. Therefore, co-accused Praveen Ram inflicted a blow with iron rod on his head causing him head injuries and he also took out cash Rs.1000/- from the informant's pocket. So far this petitioner is concerned, he is alleged to have damaged mobile phone of the informant.

4. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.10113 of 2024(3) dt.18-10-2024 2/2 submits that there is no allegation against the petitioner of causing hurt to the informant. No overt act has been alleged against the petitioner. As a matter of fact, informant and his family members assaulted the petitioner and outraged modesty of his wife for which CR Case No. 201 of 2023 has been filed before the Special Judge, SC/ST Act. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
