JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 23/05/2014 in a case registered for the offences punishable under Sections 341, 323, 504 and 302/34 of the Indian Penal Code. It is alleged by the informant that the petitioner and three others assaulted her husband with lathi and bicycle chain, as a result of which the husband of the informant died. It is submitted by learned counsel for the petitioner that as per FIR the occurrence took place at 10 P.M. in the night whereas as per subsequent statement the occurrence took place at 6 A.M and the time of death assessed during post mortem create doubt about the accusation against the petitioner levelled by the informant.
