Petitioner, in the present case, is seeking regular bail in connection with Sessions Trial No. 833/2019 (arising out of Nadi P.S. Case No. 77/2019) registered for the offence under Section 341/323/387/504/364/34 of the Indian Penal Code. Petitioner is in custody since 24.03.2019 having no criminal antecedent as stated in paragraph '3' of the application. Having regard to the order dated 23.06.2021 passed in Cr. Misc. No. 14578/2021 by which this Court had granted liberty to the petitioner to renew his prayer for bail if the trial is not concluded within a period of six months and further considering that petitioner is in custody since 24.03.2019 and charge in this case was framed on 23.08.2019, but till date only one witness out of six charge-sheeted witnesses has been

No.8033 of 2022(3) dt.21-09-2022 2/2 examined and the trial is not likely to be concluded in near future, this Court directs release of the petitioner above named on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - 3rd, Patna City (Patna) in connection with Sessions Trial No. 833/2019 (arising out of Nadi P.S. Case No. 77/2019), subject to the condition as laid down under Section 437 (3) Cr.P.C. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner.

However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
