The petitioner apprehends his arrest in a case registered for the offences punishable under Section 4 of Fertilizer (Control) Order 1985 and section 7(I)(a)(ii), 3(2)(e) Essential Commodities Act.

As per the prosecution case, petitioner is involved in storage and black-marketing of urea. During inspection of Godown as well as residence of Bijendra Kumar Sainik, one pick-up van Registration No. JH 03W 8013 was found standing loaded with several bags of Urea. It is alleged that petitioner being driver of the said vehicle fled away after seeing the police party.

No.8474 of 2023(2) dt.24-04-2023 2/2 It is submitted that petitioner has been falsely implicated in this case simply because he was driving the said vehicle at the instruction of owner. Petitioner is nowhere involved in the selling of Urea. Owner of the vehicle in question has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 24.08.2022 passed in Cr. Misc. No. 1935 of 2022. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 336 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
