JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Earlier the prayer for bail of the petitioner was rejected by a co-ordinate Bench of this Court vide order dated 17.3.2015 passed in Cr. Misc. No.48313 of 2014 taking note of this fact that prayer for bail of co-accused namely, Sunil Rai had already been rejected by this Court.

Submission on behalf of the petitioner is that having similar allegation co-accused Sunil Rai and others have already been granted privilege of bail by different Benches of this court. It is further contended that there is contradiction between injury report issued by I.O and medical officer of Primary Health Centre

Patna High Court Cr.Misc. No.44439 of 2015 (3) dt.12-01-2016 2/2 as well as post mortem report and the aforesaid contradiction makes the allegation doubtful.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Danapur in connection with Naubatpur P.S.Case No. 182 of 2014, G.R.No. 1199 of 2014.
