The petitioner is in custody since 22.07.2015 in connection with a case registered the offences punishable under Sections, 457,380, 382/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there has been no recovery from his possession, it has been stated that the petitioner was chased and he was apprehended while trying to commit theft in the house of the informant. It is submitted that there has been no recovery in this case and the petitioner has not been placed on Test Identification Parade.

Considering the aforementioned submissions and also the period of custody, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.45258 of 2015 (3) dt.08-02-2016 P2/2 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S.
