JUSTICE MUNGESHWAR SAHOO ORAL ORDER 02-09-2016 Heard the learned counsel, Mr. Ganapathy Trivedi, for the petitioner and the learned A.C. to G.A.13 for the State. Perused the impugned order dated 11.04.2016 passed by the learned Munsif Naugachia in Title Suit No.54 of 2001 whereby the learned Court below has rejected the application filed by the present petitioner for consolidating Title Suit No.54 of 2001 and Title Suit No.50 of 2009 for hearing.
Admittedly, the plaintiff of Title Suit No.54 of 2001 is not a party in the subsequent suit filed by the intervener which has been filed for declaration of title and correction of the entry in the record of right with respect to two plots.
From perusal of the impugned order, it appears that the evidence of both the parties in Title Suit No.54 of 2001 has already been closed and it is at the stage of argument. Now, at this stage, therefore, there is no question of consolidate hearing of both
Patna High Court C.Misc. No.502 of 2016 (2) dt.02-09-2016 2/2 the suits arises.
