====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 15-11-2021 Heard Sri Nitya Nand Neeraj, learned counsel for the petitioner and Sri Awadhesh Kumar Singh, learned A.P.P. appearing for the State.

The petitioner seeks bail in connection with Shakurabad P.S. Case No. 77 of 2019, registered under Sections 341, 323, 307, 385, 435, 504 and 506/34 of the Indian Penal Code. As per the allegation made in the F.I.R., the petitioner assaulted the informant by means of iron-rod on his head as a result of which the informant sustained head injury and fell down. It has further been alleged that other co-accused set the crops of the informant on fire.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case and he has been made accused due to village politics and previous enmity with the informant. He has further submitted that from perusal of the injury report also the injury is simple in nature.

Patna High Court CR. MISC. No.17727 of 2021(4) dt.15-11-2021 2/2 Learned A.P.P., however, opposes the prayer for bail. Having considered the allegations made in the F.I.R. as well as the injury report and the submissions made on behalf of petitioner and the State, I am of the opinion that the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each and subject to personal bond of Rs. Two lakh by one of the close relative of the petitioner, to the satisfaction of the learned J.M.1st Class, Jehanabad in connection with Shakurabad P.S. Case No. 77 of 2019 subject to the following conditions:

(a) The petitioner shall fully cooperate with the investigation/trial of the case, failing with the Court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below.

(c) The petitioner shall not leave the country without permission of the trial Court.
