The present writ petition has been preferred for the grant of following relief/s:- a) For issuance of an appropriate writ/order/direction commanding the Respondents to forthwith pay the compensation for her land along with statutory interest acquired for construction of head quarter of the Seema Suraksha Bal Battalion.

b) For issuance of an appropriate writ/order/direction setting aside the order dt.10/08/2023 passed by the respondent District Land Acquisition Officer, Patna in Land Acquisition Case no.35/2020-21 where under

Patna High Court CWJC No.1957 of 2024(2) dt.14-05-2024 2/3 and whereby the learned District Land Acquisition Officer, Patna without there being any suit with respect to the present land has erroneously held that the matter with respect to the payment of compensation would be decided after disposal of the suit in which the land in question is admittedly not in dispute.

c) And/or for any other relief or reliefs for which the Petitioners would be found entitled to on the facts and in the circumstances of the case."

3. This Court has gone through the order dated 10.08.2023 passed by the District Land Acquisition Officer, Patna (respondent No. 4) as contained in Annexure-P/5 and he has taken note of the pendency of Title Suit No. 56 of 2019, in which, Schedule - 2 describes about this land.

4. Learned counsel for the petitioner submits that he shall be pursuing the matter before the said Court but the same is pending since last five years as would reflect from the year of the case.

5. He has valid submission, the Title Suit No. 56 of 2019 is pending for last five years and the petitioner is one of the purchasers and does not bore the fruits of the said purchase, if the contents of the writ petition is to be believed.

6. In that view of the matter, the concerned Court (learned Sub-Judge, Paliganj) shall see to it that the Title Suit

Patna High Court CWJC No.1957 of 2024(2) dt.14-05-2024 3/3 No. 56 of 2019 is taken to its logical conclusion without unnecessary adjournments after hearing the parties and this Court would expect that the same is concluded within a period of one year.
