2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 323, 341, 504, 302 of the Indian Penal Code and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.
3. As per the prosecution case, on 21.06.2024 at about 8 PM, all the F.I.R. named accused persons including this petitioner and 2-3 unknown persons, armed with deadly weapons, abused and assaulted son of informant. It is further alleged that co-accused Kaushal Kumar dragged informant's son out of the house and fired on his right chest, on account of which, son of informant died in hospital.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific allegation of firing is against co-
Patna High Court CR. MISC. No.7427 of 2025(2) dt.27-03-2025 2/2 accused Kaushal Kumar, which hit chest of the deceased. So far as this petitioner is concerned, he is only alleged to be present at the place of occurrence and assisted other co-accused persons in dragging the deceased outside the house. There is no allegation of firing against petitioner.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Chandi P.S. Case No. 77 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
