JUSTICE PURNENDU SINGH ORAL ORDER 13-03-2023 Heard Mrs. Soni Srivastava, learned counsel along with Mr. Ravi Bharadwaj, learned counsel appearing on behalf of the petitioner and Ms. Indu Kumari Srivastava, learned APP appearing on behalf of State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 430 of 2020 registered under Sections 323, 341, 342, 498(A), 504 and 506 of the Indian Penal Code.

3. On 29.11.2022, the petitioner and the opposite party no.2 had jointly prayed that they are willing to settle their strained matrimonial relationship. The matter was referred to Patna High Court Mediation and Reconciliation Centre vide

Patna High Court CR. MISC. No.7551 of 2022(5) dt.13-03-2023 2/2 order dated 29.11.2022, fixing the date of mediation on 12.12.2022. The petitioner has agreed to pay a total sum of Rs. 15 lacs, out of which, he has already paid Rs. 7,50,000/- to the opposite party no. 2 and remaining amount has been agreed by the petitioner to be paid after admission of the petition under Section 13(b) of the Hindu Marriage Act, 1956 and to that extent, the opposite party no. 2 has also consented.

4. In above view of the matter, the petitioner has made out a case for grant of pre-arrest bail.

5. Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Saran, Chapra in connection with Complaint Case No. 430 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
