The petitioner in the present case is seeking anticipatory bail in connection with Raghunathpur P.S. Case No. 17 of 2015 registered for offences punishable under Sections 467, 468, 471, 420, 417, 418, 419, 323, 379, 504, 120(B)/34 of the Indian Penal Code, pending in the court of learned A.C.J.M. VIII, Siwan.
Learned counsel for the petitioner submits that it is a case of false implication and the allegations made are all related to a share in the ancestral property. Learned counsel submits that the petitioner is said to be a purchaser and the thrust of the allegations are in the nature of a civil dispute and petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.5791 of 2020(2) dt.19-06-2020 2/3 Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances of the case wherein it appears on perusal of the records that a complaint case was filed on 03.02.2015 in the court of learned C.J.M.
Siwan in which the allegations made are all related to a share in the ancestral property, the petitioner is said to be a purchaser and the thrust of the allegations are in the nature of a civil dispute and it is the said complaint which has been referred to police and has been converted in a police case in which despite lapse of more than five years the investigation has not culminated which is evident from the observation of the learned Additional District Judge, 3rd, Siwan in the impugned order itself, in the nature of allegations, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Raghunathpur P.S. Case No. 17 of 2015 be released on bail on furnishing of bail bonds of Rs.
25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
(2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) a condition that the person shall not leave India without the previous permission of the Court. This application stands allowed.
