JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2023 Both the aforesaid cases arise out of same police station case number, and as such, both cases were taken up together and are being disposed of by this common order. Heard learned counsel for the petitioners, State and informant.

Patna High Court CR. MISC. No.74025 of 2022(4) dt.13-07-2023 2/2 The petitioners (in both cases) apprehend their arrest in a case registered for the offence under Sections 363, 365 of the Indian Penal Code and later on, Sections 302, 201/34 of the Indian Penal Code were added.

As per the prosecution case, all the F.I.R. named accused persons including these petitioners are alleged to have abducted the son of the informant and his neighbour namely Niraj Kumar and Govind Kumar respectively. It is further alleged that one of the co-accused Ashok Mandal was arrested and he confessed that he alongwith other FIR named accused, including petitioners, have committed the murder of both abducted persons and threw their dead-bodies in the Ganga river. Later on, dead-body of Niraj Kumar (son of informant) was recovered from the bank of Ganga river, but the dead-body of Govind Kumar is still traceless.

Considering the serious nature of the offence and criminal antecedents of all the petitioners, the prayer for anticipatory bail of petitioners (of both cases) is rejected. (Prabhat Kumar Singh, J) anay/- U T
