The petitioner seeks bail, who is in custody since 30.04.2020 in connection with S.Tr.No.23 of 2021 arising out of G.B.Nagar P.S. Case No. 92 of 2020, F.I.R. dated 29.04.2020 registered for the offence punishable under Sections 341,323,34,307,504,506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case.

Earlier the prayer for bail of the petitioner was twice rejected vide order dated 20.01.2021 passed in Cr. Misc. No.32904 of 2020 and order dated 13.04.2022 passed in Cr. Misc. No.57249 of 2021.

Patna High Court CR. MISC. No.8641 of 2023(3) dt.24-06-2023 2/2 Vide order dated 03.05.2023, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 12.05.2023 reveals that all non-official witnesses have been examined and official witnesses i.e. the I.O. and Doctor have to be examined.

Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.23 of 2021 arising out of G.B.Nagar P.S. Case No. 92 of 2020 pending in the court of learned Additional Sessions Judge -XI, Siwan.

Prayer is refused.

However, the learned Trial Court is directed to expedite the trial and conclude the same within a period of three months and if the trial is not concluded within the aforesaid period, the petitioner shall be at liberty to renew his prayer for bail.
