The petitioner apprehends his arrest in Jamui P.S. Case No.469 of 2018, registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the FIR. It is further submitted that during investigation, name of the petitioner surfaced in the case. No incriminating article has been recovered from conscious possession of the petitioner.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner has got three criminal antecedents of the similar

Patna High Court CR. MISC. No.12743 of 2021(2) dt.03-12-2021 2/2 nature.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
